3. Categories of personal data

Surname, first name, address, date of birth, facial images and gestures.

The processing may also include biometric data and data on health, as well as data on racial and ethnic origin and religion obtained through the processing of the images. This may be necessary, for example, to ensure accurate recognition of gestures in the context of the research project for different ethnicities - including on the basis of particular characteristics - and to identify possible "discrimination". These are special categories of personal data within the meaning of Art. 9(1) GDPR.

4. Processing purposes and legal bases

4.1 In order to carry out research projects for the training and testing of artificial intelligence methods (hereinafter: "research projects"), image recordings of you are made on the basis of your consent.

The processing is carried out for the purpose of training and testing artificial intelligence (hereinafter: "AI") methods for gesture recognition, specifically for learning, validating and improving the automatic and computer-assisted recognition of gestures for contactless human-machine interaction, among other things, through AI models and for enabling novel applications, among other things in industrial production, medicine and care. The file names of the image recordings will be given a pseudonym known only to Fraunhofer. The file names are used so that Fraunhofer can remove the images in the event of a revocation of consent in accordance with data protection regulations. The use of the image recordings for the above-mentioned purposes is also carried out by cooperation partners of Fraunhofer in joint research projects; these partners are informed that the processing is to be limited to the above-mentioned purposes.

Your name, date of birth and e-mail address are processed so that we can prove, if necessary, that we have your consent to use the images and so that we can remove the images assigned to you from the data files in the event of revocation. In addition, the admissibility of the declaration of consent is queried via the date of birth.

The data processing is based on your explicit and voluntarily given consent according to Art. 6 para. 1 p. 1 lit. a, Art. 7 GDPR. Insofar as the image recordings reveal indications of ethnicity, origin and religion or health, your consent also expressly refers to these characteristics, Art. 9 para. 2 lit. a GDPR. You can revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

4.2 If you have expressly consented to this, the data set of selected or all image recordings obtained from you alone or together with the data sets of other participants in research projects will be made available as a complete package to other scientists and research institutions exclusively for training and testing algorithms and AI models for learning, validating and improving automatic and computer-assisted recognition for scientific purposes. No other personal data such as name, date of birth or e-mail address will be passed on. The data is only passed on for processing for scientific, non-commercial use by scientists and research institutions registered by name with Fraunhofer and known to be trustworthy.

The recordings, your name, your date of birth and your e-mail address will be stored until you revoke your consent in accordance with Art. 7 (3) GDPR.

6. Recipients of the personal data

6.1 If you have given your consent to the processing of your personal data in accordance with section 4.1 above, Fraunhofer will share this data with cooperation partners in research projects. If the cooperation partners are located outside the EU or EEA or are international organizations, Fraunhofer will only share the data if the recipient ensures an adequate level of data protection.

6.2 If you have given your consent to the processing of your personal data in accordance with section 4.2 above, Fraunhofer will also share this data with other scientists and research institutions. Data will only be shared with scientists and research institutions in countries outside the EU or the EEA or with international organizations if the recipient ensures an adequate level of data protection.
